These terms govern pre-orders: payment is made today, delivery takes place later. The lead times announced are production estimates and not firm dates. Please read articles 4, 7 and 8 carefully.
These general terms and conditions of sale govern every order placed on oriquantum.ch with LMP-innovation Sàrl, Rue Saint-Randoald 18, CH-2800 Delémont, UID CHE-227.507.646 (hereinafter "the seller").
Placing an order implies unreserved acceptance of these terms in the version in force on the day of the order. The seller reserves the right to amend them; the terms applicable to an order are those accepted when that order was placed.
ORI-Locus is a pyramid made of transparent PMMA containing natural quartz, the final face of which is bonded by hand in Switzerland. ORI-Manus is a sealed pendant containing a natural stone, available in six stones and two chain finishes.
These products are decorative objects intended for personal well-being. They are not medical devices and are not a substitute for any medical advice or treatment.
As the stones and the quartz are natural materials, each item shows variations in colour, transparency and inclusions. These variations are inherent in the material and do not constitute a defect.
Current phase: pre-orders are restricted to deliveries within Switzerland and are payable in Swiss francs. Opening to France and to the euro area will follow at a later stage.
Prices are stated inclusive of all taxes and include Swiss value added tax (VAT) at the rate of 8.1%.

Delivery charges, where they apply, are shown separately before payment is confirmed and are added to the price of the items. The total amount due is always displayed before confirmation.
The products are offered on a pre-order basis. Payment is collected when the order is placed, in order to reserve the item and to start production.
The delivery lead times communicated are estimates based on the production schedule and do not constitute guaranteed delivery dates. The seller will inform the buyer of any significant change to the schedule.
Should delivery be delayed by more than thirty days beyond the estimate communicated, the buyer may request the cancellation of the order and obtain a full refund of the sums paid, including delivery charges.
As quantities are limited, the seller reserves the right to cancel and fully refund any order that it is unable to fulfil.
The buyer selects the products and, where applicable, the stone and the chain finish for ORI-Manus, then confirms the order after checking the summary. The contract is concluded when payment is confirmed.
A confirmation email, containing an order reference and the details of the items, is sent to the buyer. It is the buyer's responsibility to provide an accurate email address and delivery address.
Payments are processed by Stripe Payments Europe Ltd. The seller never has access to full payment card details. The means of payment accepted are credit and debit cards, as well as TWINT for payments in Swiss francs.
An order is processed only once payment has been confirmed by the payment service provider.
Swiss law provides for no general right of withdrawal in respect of online purchases. The seller nevertheless voluntarily grants the buyer a right of withdrawal of fourteen days from receipt of the product, without the buyer having to give any reason. This corresponds to the standard applicable in the European Union and will apply as of right to those buyers covered by it once those markets open.
As long as the order has not been dispatched, the buyer may also request its cancellation free of charge and obtain a full refund by writing to info@oriquantum.ch quoting the order reference. Given the pre-order model, this option remains open throughout the period between payment and dispatch.
As the ORI-Manus pendant is sealed, it must be neither opened nor altered. A product that has been unsealed, damaged or is incomplete cannot be taken back.
The products are dispatched to the address given by the buyer when the order is placed. A tracking number is sent to the buyer by email at the time of dispatch.
It is the buyer's responsibility to check the condition of the parcel on receipt and to report any visible damage to the carrier and to the seller as soon as possible.
Risk passes to the consumer buyer upon actual handover of the product.
The products benefit from the statutory warranty for defects in the goods within the meaning of articles 197 et seq. of the Swiss Code of Obligations (CO), for two years from delivery.
Any defect must be reported without delay after its discovery, supported by photographs. The seller will, at its option, replace or refund a product acknowledged to be defective.
Excluded from the warranty are normal wear and tear, damage resulting from improper use, from an impact, from a fall or from opening the product, as well as the natural variations in the stones described in article 2.
The seller's liability is limited to the amount of the order concerned, save in the event of gross negligence or wilful misconduct, and subject to mandatory statutory provisions. No liability is accepted for any use of the products for therapeutic purposes, as they are not medical devices.
The processing of data is described in the privacy policy, which forms an integral part of these terms.
These terms are governed by Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Delémont, Switzerland.
The mandatory provisions protecting consumers in their state of residence remain reserved. These terms were drawn up in French. In the event of any discrepancy, the French version shall prevail.
